1. Introduction and Acceptance of Terms
Welcome to Home Essentiel. By accessing or using our website and services, you agree to comply with and be bound by these Terms and Services. If you do not agree with any part of these terms, please do not use our services. These terms constitute a legally binding agreement between you and Home Essentiel regarding your use of our home improvement and repair services.
2. Home Improvement Services
Home Essentiel provides comprehensive home improvement and repair services including general repairs, plumbing, electrical work, painting, carpentry, flooring, remodeling, and maintenance services. Specific services provided will be detailed in individual Service Agreements. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to clients.
3. Client Responsibilities
Homeowners agree to: provide safe access to the work area, disclose any known hazards or issues, obtain necessary permits when required, secure valuable items and pets during service, communicate any concerns promptly, provide accurate information about the property, and pay all associated fees as agreed. Failure to meet these responsibilities may result in service delays or additional charges.
4. Estimates and Pricing
We provide free, detailed estimates before any work begins. Estimates are valid for 30 days from date of issuance. Final pricing may vary if unforeseen issues are discovered during work, in which case we will obtain your approval before proceeding. All pricing is transparent with no hidden fees. Emergency service rates may differ from standard rates and will be disclosed before work begins.
5. Payment Terms
Payment is due upon completion of services unless other arrangements are made in writing. We accept major credit cards, debit cards, and electronic payments. For larger projects, a deposit may be required before work begins, with the balance due upon completion. Late payments may incur interest charges and collection costs. All payments are processed securely.
6. Workmanship Warranty
We stand behind our work with a comprehensive warranty. Specific warranty terms vary by service type: general repairs (90 days), plumbing and electrical (1 year), painting (2 years), remodeling (1 year), and carpentry (1 year). The warranty covers workmanship issues but does not cover normal wear and tear, misuse, or damage caused by others. Warranty claims must be reported in writing within the warranty period.
7. Scheduling and Access
We strive to accommodate your schedule with flexible appointment times. If you need to cancel or reschedule, please provide at least 24 hours notice. Failure to provide adequate notice may result in a cancellation fee. You must provide safe access to the work area. If access is denied or unsafe conditions exist, we may cancel the appointment with applicable fees.
8. Emergency Services
We offer 24/7 emergency repair services for urgent issues such as burst pipes, electrical hazards, and security risks. Emergency service rates may be higher than standard rates and will be disclosed before dispatch. We prioritize safety and will not perform work that poses unreasonable risk to our technicians or your property.
9. Limitation of Liability
To the maximum extent permitted by law, Home Essentiel shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from service provision. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim. We are not responsible for existing conditions discovered during work or for damage caused by unforeseen circumstances.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States and the state where services are provided, without regard to conflict of law provisions.
11. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email or website notice at least 30 days in advance. Continued service use constitutes acceptance of modified terms.
12. Entire Agreement
These terms, together with your Service Agreement, constitute the entire agreement between you and Home Essentiel regarding service provision.
